PIL filed in Patna High Court against Panchayat Raj Ordinance of Bihar Government

Patna, June 6 (PTI) A PIL has been filed in the Patna High Court against the Panchayat Raj Panchayat Raj (Amendment) Ordinance, 2021 of the Bihar government.

In the said petition filed by advocate Priyanka Singh on Saturday, a request has been made to declare some provisions of the Bihar Panchayat Raj (Amendment) Ordinance, 2021, dated June 2, as unconstitutional.

The term of office bearers of three-tier panchayat in Bihar is going to end on June 15, 2021. Significantly, the Bihar cabinet on Tuesday approved an ordinance to amend certain sections of the Bihar Panchayat Raj Act, 2006 to enable the state government to monitor the functioning of these three-tier panchayat bodies till fresh elections are held due to Kovid-19. To be given the power to constitute Consultative Committees.

In the petition, a request has been made to direct the announcement of the election program before the end of the term of the existing three-tier Panchayat representatives of the state or to extend the tenure of the existing representatives for the next six months or till the new elections are held.

In the petition, the court has been requested to direct the respondents to restrain the administrative officers from giving the power to run the administration of the three-tier panchayat in Bihar including the village kachari.

The petition has requested to declare the Bihar Panchayat Raj (Amendment) Ordinance against Article 243E of the Constitution and the spirit of the Panchayati Raj system.
